  • These Terms and Conditions of Use (or "Terms of Use") apply to the Abby Haliti Salon, LLC ("AHS") website located at "https://www.abbyhalitisalon.com", along with all associated sites linked by AHS (collectively the "site"). By accessing, browsing, or using the site, you agree to these terms of use. If you do not agree, do not use the site.

    AHS may, without notice to you, at any time amend these Terms of Use and any other information contained on the site. You should review the Terms of Use prior to using the site. Your continued use of the site after any changes are posted to these Terms of Use constitutes acceptance of those changes.

  • All text, graphics, photographs, trademarks (registered and unregistered), logos, and artwork (the "Content"), unless otherwise stated, is controlled, licensed or owned by Abby Haliti Salon, LLC. No Content may be copied, reproduced, republished, downloaded, translated, transmitted, distributed, or mirrored in any way except with the express written permission of AHS.

    Nothing contained on the site should be construed as granting, by implication, any license or right to use any of the Content on the site.

  • By agreeing to these Terms of Use, you agree to abide by the following:

    You are responsible for obtaining and securing your own access to the site;

    In the event we discover a violation of this Acceptable Use Policy, we may, without notice, restrict or block you from using the site.

  • All Content on the site is provided AS-IS and on an AS-AVAILABLE basis. AHS does not promise that the site or any content, service or feature of the site will be error free, provided without interruption, that any defects will be corrected, or that your use of the site will provide specific results or outcomes. All information provided on the site is subject to change without notice.

    AHS cannot warrant or ensure that any files or data you download from the site will be free of defects or viruses or damaging features.

    AHS disclaims all warranties, express or implied, including any warranty of accuracy of information, non-infringement, merchantability and fitness for a particular purpose.

    AHS disclaims any and all liability for the acts, omissions and conduct of any third parties in connection with or related to your use of the site or any services provided by AHS. You assume full and total responsibility for your use of the site and any content linked to third-party sites. Your sole remedy against AHS for dissatisfaction with the site or the content is to stop using the site or any content provided. This limitation of relief is part of the bargain and consideration between the parties.

    By using the site you waive any and all claims against AHS for damages, liability or injuries caused by any failure of performance, error, interruption, omission, deletion, delay in operation, computer virus, destruction or unauthorized access to, alteration of, or use, whether for breach of contract, tort, negligence or any other cause of action.

They are not under AHS's control, and AHS is not responsible for, nor does AHS endorse, the content on such sites.   • Except as prohibited by law, in no event will AHS be liable to you, to your sub-contractors or agents, or to any third party for any loss of use, revenue or profit [or loss of data or diminution in value], or for any consequential, incidental, indirect, exemplary, special or punitive damages whether arising out of breach of contract, tort (including negligence) or otherwise, regardless of whether such damages were foreseeable and whether or not a party has been advised of the possibility of such damages, and notwithstanding the failure of any agreed or other remedy of its essential purpose.

    
AHS's liability shall in no event exceed the greater of (1) the amount of any fees paid for services provided through the site; or (2) $100.00USD.

  • To the greatest extent permitted by law, by accepting these Terms of Use you agree to defend, indemnify and hold harmless AHS and its directors, officers, employees, agents, stockholders, affiliates, subcontractors and customers from and against all allegations, claims, actions, suits, demands, damages, liabilities, obligations, losses, settlements, judgments, costs and expenses (including without limitation attorneys’ fees and costs) which arise out of, relate to, or result from your use of the site.

  • AHS may, with or without notice to you, terminate your ability to access the site, with or without cause.

  • You may not assign or transfer any of your rights or obligations under this Terms of Use without the express written consent of AHS. Assignment or transfer of this Agreement shall constitute a material breach of the same.

  • This agreement is intended solely for the benefit of you and AHS. No party, entity or individual not a party to this Agreement may bring a cause of action pursuant to this Agreement as a third-party beneficiary hereof.

  • This Agreement constitutes the entire agreement between the parties and supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between them, whether written or oral, relating to its subject matter. Each party agrees that it shall have no remedies with respect to any statement representation, assurance, or warranty (whether made innocently or negligently) that is not set out in this agreement.

  • If any provision or part-provision of this Agreement is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the extent necessary to make it valid, legal, and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this clause shall not affect the validity and enforceability of the rest of this agreement. If any provision or part-provision of this agreement is invalid, illegal or unenforceable, the parties shall negotiate in good faith to amend such provision so that, as amended, it is legal, valid and enforceable, and, to the greatest extent possible, achieves the intended commercial result of the original provision.

  • You acknowledge that AHS may terminate and/or block your access to the site in the event that AHS determines, in its opinion, that you are in violation of these Terms of Use or its Privacy Policy.

    AHS may disclose any information we have about you (including your identity) if AHS determines that such disclosure is necessary in connection with any investigation, complaint, required by law, or necessary to contact or bring legal action against someone who AHS determines to be causing injury or interference with (intentionally or unintentionally) with AHS's rights, or the rights of third-parties and other users.

    AHS reserves the right to disclose any information it deems necessary to comply with applicable law, regulations, legal process, governmental request or court orders.

    If AHS takes any legal action against you as a result of your violation of these Terms of Use, AHS will be entitled to recover from you, and you agree to pay, all reasonable attorneys' fees, costs and disbursements, in addition to any other relief granted to AHS. You agree that AHS will not be liable to you or to any third party for termination of your access to the site as a result of any violation of these Terms of Use.

  • This agreement and any disputes or claims arising out of or in connection with its subject matter are governed by and construed in accordance with the law of the state of New Jersey. Each party irrevocably agrees that the courts in New Jersey shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this agreement or its subject matter or formation (including non-contractual disputes or claims).

  • In the event AHS takes action to enforce rights under this Agreement, AHS shall be entitled to recover its reasonable attorneys’ fees, costs, and expenses incurred.

  • Any feedback you provide at this site shall be deemed to be non-confidential. AHS shall be free to use such information on an unrestricted basis.
